1. Fees

 CLIENT agrees to pay the photographer a hold a date non-refundable $125 CAD upon booking. If the CLIENT cancels this shoot for any reason, the initial payment will not be returned to the CLIENT.

The balance of the payment for photography services must be paid in full no later than on the photo shoot date. 

2. Work Product

PHOTOGRAPHER will deliver photos to CLIENT no more than 7 (seven) days after the date of the SHOOT. CLIENT understands and agrees that photos are the exclusive property of PHOTOGRAPHER and CLIENT has no right to these photos. All photos delivered to CLIENT are licensed for CLIENT’S personal use only.

PHOTOGRAPHER does NOT alter information in the images for example: removing objects, whitening teeth. 

Artistic Style

On its own behalf and on behalf of the subject: The client acknowledges that he/she is familiar with the Lilac Studio’s portfolio and is requesting services with knowledge of the company’s style and that Lilac Studio’s work is constantly evolving. No revisions are included in the fee. All raw footage and photographs remain the exclusive property of Lilac Studio’s.

3. Liability

3.1 – If PHOTOGRAPHER is unable to perform the services in this contract due to any cause outside its control, CLIENT agrees to hold no liability; however, PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this SHOOT.

3.2 – CLIENT agrees to hold harmless PHOTOGRAPHER for any liability, damage, or loss related to technological failure, including data loss.

3.3 – CLIENT understands and agrees that PHOTOGRAPHER is not required to maintain copies of the photos from this shoot 30 (thirty) days after the photos have been delivered to CLIENT.

3.4 – CLIENT agrees to hold PHOTOGRAPHER harmless for any personal injury which may occur as the CLIENT poses or works with PHOTOGRAPHER.

4. Duty of Client

PHOTOGRAPHER is not responsible for key individuals’ failure to be present or willing to cooperate during photography sessions, neither for missed images due to details not revealed to PHOTOGRAPHER. PHOTOGRAPHER is not responsible to gather individuals’ for family pictures or any other pictures.

CLIENT agrees to prevent any other photographers or videographers at the events listed from interfering with the PHOTOGRAPHER’s performance of their duties. 

PHOTOGRAPHER will not be held liable for compromised event coverage due to interference from other parties, including late arrivals of family members. 

Outfit changes are not allowed. 

5. Model Release

CLIENT grants permission to PHOTOGRAPHER and its assigns, licensees, and sub-licensees, permission to use CLIENT’S image or likeness in any and all forms of media for commercial purposes, advertising, trade,  publications, personal use, or any and all other uses. Therefore, PHOTOGRAPHER may use CLIENT’S likeness and image on PHOTOGRAPHER’S website or other advertising. 

6. Non-guarantee

While PHOTOGRAPHER will make every reasonable effort to take the photographs specifically requested by CLIENT, CLIENT understands that this is an uncontrolled event and that due to the vagaries of the time restrictions, and willingness of subjects, PHOTOGRAPHER cannot guarantee that ALL requested photos will be taken.
